Fynotek Rights

We retain the right to use general knowledge, skills, experience, and ideas gained during the project. We may also showcase the work in our portfolio unless otherwise agreed upon.

Third-Party Components

Any third-party or open-source components used will remain subject to their respective licenses.

5. Payment Terms

Payment terms will be specified in individual project agreements and may include:

• Late payment fees and consequences

6. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary information received during the course of the business relationship. This obligation survives the termination of any project agreement.

Confidential information does not include information that was publicly known at the time of disclosure or becomes publicly known through no fault of the receiving party.

7. Warranties and Disclaimers

We warrant that our services will be performed in a professional and workmanlike manner. However, we do not guarantee that the services will be error-free or uninterrupted.

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Fynotek is not responsible for delays or issues arising from incomplete or inaccurate information provided by the client.

8. Limitation of Liability

IN NO EVENT SHALL FYNOTEK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claim arising out of or relating to these terms or our services shall not exceed the amount paid by you for the services in the twelve (12) months preceding the claim.

9. Termination

Either party may terminate a project agreement according to the terms specified therein. Upon termination, you shall pay for all services rendered up to the termination date.

10. Governing Law

These terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right to modify these terms at any time. We will notify you of any changes by posting the new terms on this page.
